These terms are an agreement between you and Data Active Consulting (Pty) Ltd (registration number 2016/422133/07), of 323 Lynnwood Road, Menlo Park, Pretoria, Gauteng, 0081 (“KraalBook”, “we”, “us”). By creating an account or using the KraalBook app or website, you agree to these terms. If you don't agree, please don't use the service.
KraalBook is a livestock traceability and record-keeping tool for South African farmers. It lets you register cattle, sheep, goats and pigs, record events, and produce fact sheets and §6/§8 removal certificates. KraalBook is a record-keeping aid — it does not replace your own legal obligations (see clause 6).
KraalBook is generally available: the iPhone app is distributed through the Apple App Store, and the Android app through Google Play. KraalBook is under active development — features may be added, changed or retired as the service evolves — and the service is provided on an "as is" and "as available" basis (see clause 10). We may contact users about issues and updates that affect their account.

The records you capture are yours, and you are responsible for their accuracy. We process your information as described in our Privacy Policy. You're responsible for keeping your own copies of any documents you need (e.g. exported certificates and fact sheets).
We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to install and use the KraalBook app and website to run your own farming operation, in line with these terms. This licence lasts for as long as you keep to these terms.
KraalBook — including the app, the website, the “KraalBook” name and logo, the design, and all software and content we provide — belongs to Data Active Consulting (Pty) Ltd (or our licensors) and is protected by law. These terms don't transfer any of our intellectual property to you. The records and data you capture remain yours (see clause 5).
You may not copy, modify, translate, distribute, sell, rent, sub-licence, reverse-engineer or try to extract the source code of KraalBook, except where the law expressly allows it (see also clause 4, Acceptable use).
KraalBook is free to download and includes a 30-day free trial with full functionality; no payment details are needed to start. After the trial, continued use requires a subscription sized to your herd (by number of active animal records), paid monthly or annually at the prices shown on our website's Pricing page and at sign-up. Prices include VAT. Your plan price does not increase automatically: if your herd grows past your plan we'll tell you, and the price only changes once you agree to the new plan. We'll also give you reasonable notice of any general price changes before they take effect.
Payment. You subscribe and pay on our website — not inside the app. Payments are processed securely by PayFast, a South African payment provider; your card details are held by PayFast, not by us.
Delivery of the service. KraalBook is a digital service — nothing physical is shipped. Access is delivered electronically: the free trial starts as soon as you create your farm, and a paid subscription is activated on your account as soon as your payment is confirmed (usually immediately).
Cancellation. You can cancel your subscription at any time on the website. Your plan then runs to the end of the period you've already paid for (the month or the year), and you won't be billed again. When the paid period ends, your account becomes read-only: you can still sign in, view everything and export your records — you just can't capture new ones unless you subscribe again. Cancelling doesn't delete your records (see clause 5 and our Privacy Policy).
Refunds. Because the free trial lets you evaluate the full service before paying, subscription fees already paid are generally not refundable, except where a refund is required by South African law (including the Consumer Protection Act, where it applies). If we have billed you in error — for example a duplicate charge — tell us via the contact form and we'll correct it and refund the difference.
If a payment fails. A failed payment never blocks you from capturing records while your account is otherwise in good standing — we retry the payment and let you know. If the subscription lapses, the account moves to read-only as described above until you're paid up again.
We aim to keep KraalBook running, but we don't guarantee uninterrupted or error-free service. We may carry out maintenance, change features, or suspend the service when reasonably necessary. The app is designed to work offline and sync later, but you should still keep your own backups of critical documents.
To the maximum extent allowed by law, KraalBook is provided "as is" without warranties of any kind. We are not liable for any indirect or consequential loss, or for loss arising from inaccurate records, missed deadlines, failed syncs, or reliance on generated documents. Nothing in these terms limits any liability that cannot lawfully be limited (including under the Consumer Protection Act, where it applies).
You can stop using KraalBook at any time. We may suspend or end access if you breach these terms or use the service in a way that risks harm to others or to the service. We'll act reasonably and, where possible, give notice.
We may update these terms. We'll change the "last updated" date above and, for significant changes, let you know in the app or by other reasonable means. Continuing to use KraalBook after a change means you accept the updated terms.
These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction.
