Terms of Service

Last updated: [DATE] · Applies to the KraalBook app and website

⚠️ Draft — pending legal review. This is a plain-English working draft and is not yet legal advice. It must be reviewed and approved by a South African–qualified attorney before KraalBook is opened to public signups. Items in [square brackets] still need to be filled in.

These terms are an agreement between you and [Registered company name (Pty) Ltd] (“KraalBook”, “we”, “us”). By creating an account or using the KraalBook app or website, you agree to these terms. If you don't agree, please don't use the service.

1. What KraalBook is

KraalBook is a livestock traceability and record-keeping tool for South African farmers. It lets you register cattle, sheep, goats and pigs, record events, and produce fact sheets and §6/§8 removal certificates. KraalBook is a record-keeping aid — it does not replace your own legal obligations (see clause 6).

2. Pilot / early access

KraalBook is currently offered as an invitation-only pilot. Features may change, pause or break, and the service is provided on an "as is" and "as available" basis during this period. We may contact pilot users about issues and updates.

3. Your account

4. Acceptable use

You agree not to:

5. Your records and data

The records you capture are yours, and you are responsible for their accuracy. We process your information as described in our Privacy Policy. You're responsible for keeping your own copies of any documents you need (e.g. exported certificates and fact sheets).

6. Compliance is your responsibility

KraalBook helps you keep and produce records, but you remain responsible for complying with all applicable laws — including animal identification, traceability, movement, FMD and Stock Theft Act requirements. Documents generated by KraalBook (including §6/§8 certificates and fact sheets) are based on the information you enter. We do not warrant that they meet every requirement of any particular authority, auction house or transaction; you should check them before you rely on them.

7. Subscriptions & payment

During the pilot, KraalBook is provided free or as otherwise agreed. Paid subscriptions and payment terms [to be confirmed before launch] will be described at signup and apply from the date they take effect.

8. Availability

We aim to keep KraalBook running, but we don't guarantee uninterrupted or error-free service. We may carry out maintenance, change features, or suspend the service when reasonably necessary. The app is designed to work offline and sync later, but you should still keep your own backups of critical documents.

9. Disclaimers & limitation of liability

To the maximum extent allowed by law, KraalBook is provided "as is" without warranties of any kind. We are not liable for any indirect or consequential loss, or for loss arising from inaccurate records, missed deadlines, failed syncs, or reliance on generated documents. Nothing in these terms limits any liability that cannot lawfully be limited (including under the Consumer Protection Act, where it applies). [Final liability wording to be set by your attorney.]

10. Suspension & termination

You can stop using KraalBook at any time. We may suspend or end access if you breach these terms or use the service in a way that risks harm to others or to the service. We'll act reasonably and, where possible, give notice.

11. Changes to these terms

We may update these terms. We'll change the "last updated" date above and, for significant changes, let you know in the app or by other reasonable means. Continuing to use KraalBook after a change means you accept the updated terms.

12. Governing law

These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction.
